ENTRANCE & ELIGIBILITY: This Sweepstakes is open worldwide (International) but only intended for legal residents of countries that are deemed legal to participate. This Giveaway shall only be administered and assessed according to applicable State and U.S. law as this is the location of the sponsor (Overkill Gaming). Forgo entering this Sweepstakes if you are located in a country that does not allow giveaways or sweepstakes or are otherwise ineligible to enter in accordance with these Official Rules at the time of entry. This sweepstakes is Void where restricted or prohibited by law. To accept the prize you must be at least eighteen (18) years of age or the considered age of majority, whichever is older, in your defined State and Country of residence. For example: if you win the giveaway and you are under 18 years of age you can have your family member or parent accept the prize on your behalf. Officers, Employees, the Administrator, and representatives of the Sponsor, any respective parent companies, employees, directors, affiliates, subsidiaries, distributors, and advertising and promotional agencies, sales representatives, and the directors, agents, and employees of each of the foregoing, immediate family members (defined as: spouse, biological, adoptive and step-parents, grandparents, siblings, children and grandchildren, and each of their respective spouses) or households (whether related or not) of any of the above (are all considered the “Released Parties”) and are deemed ineligible to participate in this Sweepstakes. Non-compliance or Non-eligibility with any of these Official Rules will result in immediate disqualification. This sweepstakes is Void where restricted or prohibited by law.

AGREEMENT TO OFFICIAL SWEEPSTAKES RULES: By participating in this sweepstakes, all Entrants agree to follow, practice, and abide by all rules, by participating you also agree be bound by the Official Rules and the decisions of the Sponsor/Administrator, which will be binding and final in everything relating to the Sweepstakes. Winning the sweepstakes grand prize is subject to fulfilling all requirements set forth herein.

HOW TO ENTER: The Sweepstakes begins at 2025-02-20 4:30:00 PM EST and ends at 2025-03-20 4:00:00 PM EST (“Sweepstakes Period”). The Administrators database computer is the official time-keeping device for the Sweepstakes. Giveaway start and end dates can move left or right if the sponsor deems it necessary, but will not be moved more than two weeks past original ending date. This allows Overkill to adjust upcoming sponsors to better fit the campaign. You (Entrants) may enter in one of Three (3) ways, described as the following:

(the “Mail-In Entry”). All entries must be postmarked from 2025-02-20 4:45:00 PM and received by 2025-03-20 4:00:00 PM

Every mail-in entry received will be worth five (5) Sweepstakes entries. **NOTE: The mail in entry must be handwritten! Entrants are not permitted to use any 3rd party organization to assist with the entry process in any way (as determined by the SPONSOR/ADMINISTRATOR). Each Envelope must be mailed separately. In Bulk shipments of envelopes will not be accepted. You may Submit up to 200 postal entry requests per sweepstakes. Each Mail-In Entry received will count as five (5) entries into the Sweepstakes once validated that the Mail-In Entry complies with the above requirements.

Entries are limited to One Thousand (1000) sweepstakes entries per entrant, regardless of method of entry. In order to be considered valid, the entrant must provide all requested information. Proof of entry information at the Website is not considered valid proof of delivery to or receipt by Sponsor of an entry. Entries made by any other individuals other than yourself, or any entity, and/or originating at any other website or email address, including, but not limited to, commercial Sweepstakes subscription notification and/or sweepstakes entering service sites, will be disqualified and declared invalid for this Sweepstakes. Using any automated entry device is prohibited and no mechanically generated entries are allowed; all previous mentioned entries are void. The Released Parties are not liable for incomplete, delayed, undelivered, or otherwise misdirected entries. By participating in the sweepstakes, you consent to the Sponsor’s and its agents’ use of your personal information for the administration of this Sweepstakes.

GENERAL CONDITIONS: In the event the operation or sponsor/administration of this Sweepstakes is impaired or unable to run it as planned for any reason, including but not limited to (I) infection by computer malware or Viruses, (II) unauthorized interventions or tampering, (III)Technical Failures, (IV)fraud, or (V) other factors beyond the control of the Sponsor that may debase or affect the sponsor/administration, fairness, security, integrity or true and proper conduct of the Sweepstakes, the Sponsor/Administration holds the right at its sole discretion, to inspect and disqualify any entrant or individual who tampers with the sweepstakes or entry process. The sponsor then holds the right to terminate, modify or suspend the Sweepstakes in whole or in part, at any time, without notice and award the sweepstakes grand prize, using all verified eligible entries received as of, or after (if applicable) this cancellation, termination, modification or suspension, or in any manner that is fair and just and best conforms to the original spirit of these Official Sweepstakes Rules. The Sponsor/Administration reserves the right, with sole discretion, to disqualify and or ban any individual deemed to be attempting to tamper with the operation of the Sweepstakes, entry methods, or Overkill Website; You will also relinquish your entries by acting in an unruly, disruptive, or unsportsmanlike manner. If the Sponsor/Administrator fails to enforce any provision of the Official Sweepstakes Rules it shall not constitute a waiver of that provision.

CAUTION: ATTEMPTING TO DELIBERATELY DAMAGE ANY WEBSITE OR SABOTAGE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS AN INFRACTION AND VIOLATION OF CIVIL AND CRIMINAL LAWS, SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR/ADMINISTRATION RESERVES THE RIGHT TO SEEK DAMAGES AND OR OTHER MEANS OF RESTITUTION FROM ANY SUCH PERSON (S) HELD LIABLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

The winner is randomly selected through a computerized random script. The winner does not need to be present to win. If the sponsor/Administrator is unable to access the Entrants emails and social accounts within 96 Hours of the competition drawing, the sponsor/administrator reserves the right to draw the winner offline, and provide notice to the winner as indicated below.

Potential Winner Contact. The potential winner(s) will be contacted via the email provided and all other collected social platforms directly after the drawing, and the potential winner will be required to reply to any of the forms of contact within 48 Hours after receipt of the notice from Sponsor/Administrations to confirm receipt of the notification and obtain additional instructions. Failure to respond to Sponsor/Administrations email within the stated time period will result in forfeiture of any potential winnings. Sponsor/Administrations computer is the official timekeeper and all determinations are based upon Sponsor/Administrations timekeeping device. Upon notice from the potential winner to Sponsor/Administration, the winner shall receive Prize Claim Documents. The potential winner must complete and return Prize Claim Documents within ten (10) business days of the receipt of such documents, or the time period stated in the notification, or the potential winner may be disqualified and forfeit the prize.

PRIZE CLAIM DOCUMENTS: The documents to claim the prize may include, but are not limited to: a Release of Liability, a Declaration or Affidavit of Eligibility (as solely determined by Company), a Federal IRS form W-9 for tax filing purposes (for the year a prize is received) a Publicity Release (where lawful), and such other documents as may be determined by the Sponsor/Administration. If the winner is International (Outside the United States) .
Non-U.S. citizen: when the prize is awarded to a non-citizen, there is a Five step process that must be followed. 1. The “WINNER’S AFFIDAVIT OF ELIGIBILITY AND LIABILITY/PUBLICITY RELEASE” Must be signed. 2. The IRS Form W-8BEN is filed by the Foreign national prize winner to report the amount received and the 30% withholding in the prize Value. 3.Overkill will Collect the 30% of the prize Value to be withheld for taxes. 4. Overkill must fill out the IRS Form 1042, reporting U.S. Source of Income by Foreign Persons. 5. Overkill will collect the shipping and insurance fees associated and then process shipping.

Shipping: Please Note, that Overkill Giveaways will not be responsible for customs or shipping fees, or insurance related to the Prize. Winner assumes the fees associated.

All Prize Claim Documents must be returned as provided in these Official Rules, or as otherwise stated in the notice to the potential winner. Grand Prizes that require shipping to the winner will ship approximately 1 (one) week or less from date of confirmation of eligibility and Sponsor/Administrations receipt of Prize Claim Documents. Sponsor/Administration will provide tracking to the winner if available. If potential winner fails to provide Prize Claim Documents within the time period specified in these Official Rules, or potential winner is deemed ineligible to claim the Grand Prize, as determined by the Sponsor/Administration, the potential winner will not receive the Grand Prize, which Grand Prize shall be forfeited, and no replacement or other compensation of any sort will be provided by the Sponsor/Administration.

RELEASE AND LIMITATIONS OF LIABILITY: By taking part in the Sweepstakes, entrants agree to release and hold harmless all released parties from and against any claim or cause of action arising out of participation in the sweepstakes or receipt or use of any prize, including, but not limited to: (I) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Sweepstakes or receipt of the Grand Prize. Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. (II) printing errors (III) unauthorized human intervention in the Sweepstakes;; (IV) Any technical errors that make an entrant unable to submit an entry; or (V) Errors in the administration of the sweepstakes or errors processing an entry. Released Parties are not responsible for any problems or malfunction of any telephone network or telephone lines, computer equipment, servers, or providers, software, failure of any email or entry to be received by sponsor/administrator on account of technical problems, human error or traffic congestion on the website or internet, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer relating to or resulting from participation in this sweepstakes or downloading any materials in this sweepstakes. Entrant further agrees that in any case or cause of action, the released parties’ liability will be limited to the cost of entering and participating in the sweepstakes, and in no event shall the released parties be liable for attorney fees. Entrant forgoes the right to claim any damages whatsoever, including, but not limited to, consequential, punitive, direct, or indirect damages.

DISPUTES: All problems, issues and questions concerning the framework, construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of Entrants, Administrator, and Sponsor in connection with the Sweepstakes shall be governed by and construed in accordance with the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s or jurisdiction’s laws. By participating in the Sweepstakes, Entrant agrees that: (I) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, shall be resolved individually without resort to any form of class action; (II) any judicial proceeding shall take place in a federal or state court within the State of Florida; (III) any and all claims, judgments , and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event will attorney fees be awarded or recoverable; (IV) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to seek, punitive, incidental, exemplary, consequential, special damages, lost profits, other damages, and/or any rights to have damages multiplied or otherwise increased; and (V) Entrant’s remedies are limited to a claim for money damages (if any) and he/she waives any right to seek injunctive or equitable relief.

SEVERABILITY: The unenforceability or invalidity of any provision of these Official Sweepstakes Rules will not affect the validity or enforceability of any other provision of these rules. If any part of these Official Rules is determined to be invalid or otherwise unenforceable, all other provisions will remain in effect and will be construed as if the invalid or unenforceable provision were not contained herein.

MISCELLANEOUS: These Official Sweepstakes Rules contain the full and complete understanding with respect to the Sweepstakes and supersede all prior agreements, representations and understandings, whether written or oral. The titles and headings herein are for convenience only, and do not constitute a part of these Official Rules, and shall not be deemed to limit or affect any of the parts therein. There will be no amendment to, or waiver of, any provision of these Official Rules shall be effective unless in official writing and signed by the Sponsor/Administrator. The waiver by Sponsor/Administrator of any provision of these Official Rules shall not constitute a waiver of any other provision herein. The rights and obligations hereunder may not be assigned by Entrant, whether by operation of law or otherwise, without the prior written consent of Sponsor/Administrator, and any attempted assignment in violation of the foregoing shall be discredited. These Official Sweepstakes Rules shall be binding upon, and inure to the benefit of, the permitted successors and assigns of Sponsor, Administrator, and Entrant.

Email Lists: All email and contact information can be used by companies involved in the Giveaway to email winners and or promotional material for products from the sponsors. You agree by entering that your email WILL be shared with sponsors involved for marketing purposes.
